These Terms of Service ("Terms") constitute a legally binding agreement between you and Nextline ("we," "our," or "us") governing your access to and use of our real estate platform, website, mobile applications, and related services (collectively, the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our Service. These Terms apply to all visitors, users, and others who access or use the Service.
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. You are advised to review these Terms periodically for any changes. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
Our Service provides a platform for users to search, list, buy, sell, and rent real estate properties. You may use our Service for lawful purposes only and in accordance with these Terms.
You agree not to use the Service in any way that violates any applicable law or regulation, infringes on the rights of others, or interferes with or disrupts the Service or servers connected to the Service.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
To use certain features of our platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including if you violate these Terms of Service or engage in fraudulent, abusive, or illegal activity.
You agree that all property information, including descriptions, photos, prices, and availability, is accurate and truthful. You are solely responsible for the content of your listings and must ensure compliance with all applicable laws and regulations.
You represent and warrant that you have the legal right to list the property, either as the owner, authorized agent, or with proper authorization from the property owner. You must have all necessary permissions and documentation.
We reserve the right to review, edit, reject, or remove any listing at any time for any reason, including but not limited to inaccurate information, violation of these terms, or suspected fraudulent activity.
You agree to keep your listings up to date, including promptly marking properties as sold, rented, or unavailable. Failure to do so may result in removal of your listing or account suspension.
You may not use our platform for any illegal purpose or in violation of any local, state, national, or international law or regulation. This includes but is not limited to fraud, money laundering, or discrimination.
You may not post false, misleading, or deceptive information. This includes fake listings, inaccurate property details, fraudulent pricing, or impersonation of other users or entities.
You may not spam other users, send unsolicited communications, or engage in harassment, threats, or abusive behavior. You may not use automated systems to access our platform without authorization.
You may not upload content that infringes on any third party's intellectual property rights, including copyrights, trademarks, or patents. You may not use our platform to distribute unauthorized copies of copyrighted material.
You may not attempt to interfere with, disrupt, or damage our platform, servers, or networks. This includes introducing viruses, malware, or other harmful code, or attempting to gain unauthorized access to our systems.
Certain features and services may require payment. All fees are displayed before you complete a transaction. You agree to pay all fees associated with your use of paid services. Payments are processed through secure third-party payment processors.
Refund policies vary by service. Premium listing fees may be refundable within a specified period if the listing has not been published. Contact our support team for refund requests. All refunds are subject to our review and approval.
We reserve the right to change our pricing at any time. Price changes will not affect fees for services already purchased, but will apply to future transactions. We will notify you of significant price changes.
You are responsible for any taxes, duties, or fees applicable to your use of our services. We may collect taxes as required by law, but you remain responsible for ensuring compliance with all tax obligations.
All content on our platform, including text, graphics, logos, images, software, and other materials, is owned by Nextline or our licensors and is protected by copyright, trademark, and other intellectual property laws.
You retain ownership of content you post on our platform, including property listings, photos, and reviews. By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content on our platform.
You are solely responsible for any content you post. We do not endorse or assume liability for any user-generated content. We reserve the right to remove any content that violates these terms or is otherwise objectionable.
The Nextline name, logo, and all related names, logos, and marks are trademarks of Nextline. You may not use our trademarks without our prior written permission.
We strive to provide reliable service, but we do not guarantee that our platform will be available at all times or free from errors, interruptions, or defects. We are not liable for any downtime or service interruptions.
We do not verify the accuracy of all property information posted by users. We are not responsible for any errors, omissions, or misrepresentations in property listings. Users should independently verify all property information.
We are not a party to any real estate transactions between users. We do not guarantee the completion of any transaction, the accuracy of property information, or the performance of any user. All transactions are at your own risk.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
You agree to indemnify, defend, and hold harmless Nextline, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of our platform, violation of these terms, or infringement of any rights of another.
You agree to indemnify us for any claims, damages, or expenses arising from disputes between you and other users, including but not limited to property transactions, listing disputes, or user interactions.
If you have any dispute with us, you agree to first contact us and attempt to resolve the dispute informally. If we cannot resolve the dispute within 60 days, you agree to resolve the dispute through binding arbitration or in the courts of Rwanda, as applicable.
You agree that any dispute arising out of or relating to these Terms or the Service will be resolved on an individual basis and not as part of a class action or representative proceeding.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to delete your account.
All provisions of these Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of Rwanda, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Rwanda.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nextline regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter of these Terms.
